1.1 What Ocio is. Ocio is an online digital platform that connects organizations and end users. Organizations use the platform to list and manage their products and services. End users access information about these products and services through the Ocio platform. You reach Ocio through an organization's website or app, through Ocio's own websites and apps, or through an AI assistant powered by Ocio.
1.2 Organizations. In these terms, "organization" means anyone who offers products or services through the Ocio platform. Organizations may be commercial, non-profit, voluntary or administrative, and include companies, clubs, associations, partnerships and sole proprietorships or other single-person businesses, whether registered or unregistered. We use the word "organization" for all of them interchangeably. Where a distinction between them is necessary, we make our best effort to make it clear.
1.3 What these terms cover.
(a) For every user. These terms are the agreement between you as an end user and Apsara Software GmbH for your Ocio account and your use of the platform. They apply on every website and app powered by Ocio.
(b) If you act for an organization. If you are an owner, representative or member of staff of an organization, these terms apply to you as well. Additional terms may also apply, governed by other contracts. Using the platform to manage an organization, and accepting these terms, does not give you any rights beyond those the organization grants you, and does not reduce your responsibilities towards the organization you represent (see § 3).
(c) Without an account. These terms also apply if you do not create an account but access websites and apps powered by Ocio in any other way. The parts that concern an account apply once you have one.
1.4 What they do not cover.
2.1 Age. You must be at least 18 years old to create and use an Ocio account.
2.2 One account everywhere. Your Ocio account works on every website and app powered by Ocio. Signing up on one of them creates the account you can use on all the others.
2.3 Your details. Keep the information in your account accurate and up to date. You can sign up with your email address and a password, or with a sign-in provider such as Google where the website offers it. We send notices about your account and these terms to the email address in your account, or show them in the app; keep that address up to date.
2.4 One person, one account. An account is personal and may not be shared or transferred. Do not create further accounts to get around a restriction or suspension. How to keep your account secure is described in § 13.
3.1 Who this applies to. This section applies if you use your account as an owner, administrator, teacher or other member of staff of an organization, or otherwise on its behalf.
3.2 Your responsibilities. You must use the platform in accordance with your legal and ethical responsibilities towards the organization you act for, and only within the authority the organization has given you.
3.3 When the platform allows more than you are authorized to do. The platform may technically allow you to do things you are not authorized to do, for example to see, change or delete data, or to issue refunds. That the platform allows an action does not authorize it; do not perform it.
3.4 When the platform restricts you. If the platform prevents you from carrying out your duties, do not try to work around it. Ask the responsible person of your organization, with whom we maintain the business relationship, to contact us.
4.1 Your contract is with the organization. Products and services offered on an organization's website or app, including but not limited to classes, courses, bookings, memberships, passes and tickets, are offered by that organization. When you book or buy, the contract is between you and the organization. The organization decides what it offers, at what price, and on what conditions, and is responsible for delivering it.
4.2 The organization's terms. Each organization publishes its own terms, including its rules on cancellation, refunds, no-shows and conduct. You are asked to accept them before you buy. Please read them: they, not these terms, decide what you are entitled to from the organization.
4.3 Payment. Online payments are processed by our payment provider, Stripe, and go to the organization. We never see or store your full card details. Receipts and invoices for your purchase come from the organization.
4.4 Cancellations and refunds. Cancellations and refunds follow the organization's terms and the law. Refunds are made in money: payments made through Ocio are refunded through the platform, and payments made directly to the organization are refunded by the organization. The Ocio platform does not issue credit or keep balances.
4.5 Booking confirmations. After a booking is confirmed you may receive a confirmation and a QR code to show at the venue. The code is valid only for that booking.
4.6 What Ocio does not do. Ocio provides the technology. We do not run the classes, venues or events, employ the teachers, or check the quality, safety or accuracy of what organizations offer. If something goes wrong with what you bought, contact the organization; see § 12.3.
4.7 Events from other sources. Some apps show events listed by third parties. We show them for convenience and do not check them. Booking such an event happens with the organizer, either on Ocio or on the organizer's own website.
5.1 What is published. Websites and apps powered by Ocio publish content provided by organizations, by end users and by other third parties, for example descriptions of offers, profiles, reviews and event listings. Content that comes from someone other than Ocio is marked as such or is recognizable as such from its context.
5.2 Sharing. You may share a link to any publicly accessible page, including pages that show other users' public profiles or content. You may also copy and share published content for non-commercial purposes. This does not cover other users' personal data, such as their profiles and messages, which you may not copy, collect or republish without their permission; sharing a link to it is allowed.
5.3 Responsibility for content. Whoever provides content is solely responsible for its accuracy and validity. You release Ocio from any liability for misunderstanding or harm of any kind caused by content provided by others, including but not limited to financial, physical, psychological and personal harm.
5.4 Search engines and AI applications. Ocio allows selected search engines and AI applications to read published content through an explicit allow list. Unless you are on that list, you may not scrape, crawl or otherwise automatically extract published content.
6.1 You own it. Content you post (profile details, photos, messages, plans, reviews and the like) remains yours.
6.2 How we present it. Ocio publishes content in a form that is easy for end users to understand and navigate. When you publish content, you allow Ocio to publish it in the form of its choosing, for example formatted, shortened, translated or arranged together with other content.
6.3 Permission you give us. You allow us to store, display, adapt and deliver your content, as far as needed to run the platform, show your content to the people you share it with, and let others share it as described in § 5.2. This permission ends when you delete the content, except for copies that others already received and backups that are deleted on schedule.
6.4 AI applications and other software. AI applications, AI agents and other third-party software may present your content to other users in a changed form, or interpret it, in ways Ocio cannot control. Ocio is not responsible in any way for how third-party software or AI agents present or interpret content you provided.
6.5 Your responsibility. Post only content you are allowed to share, and that does not break the law or other people's rights.
6.6 Feedback. If you send us suggestions for improving Ocio, we may use them freely.
7.1 The platform belongs to us. The Ocio platform, including its software, design, the name "Ocio" and its logo, belongs to Apsara Software GmbH or its licensors.
7.2 How you may use it. You may use the platform only for its intended purpose. You may not copy, sell, decompile or reverse-engineer it, except where the law expressly allows this.
7.3 Rights of organizations and others. Names, logos and content of organizations and other third parties belong to them.
8.1 Do not:
(a) break the law, or harass, threaten, deceive or discriminate against anyone;
(b) post sexual, violent, hateful or extremist content, or content that encourages self-harm;
(c) post other people's personal data without their permission;
(d) pretend to be someone else;
(e) send spam or advertising that nobody asked for;
(f) collect other users' data, or use bots or scrapers on the platform unless allowed under § 5.4 or with our written permission;
(g) attack, overload or try to break into the platform, or get around its security, limits or moderation decisions;
(h) make reports you know to be false.
8.2 Child safety. We do not tolerate any content or behaviour that sexualises, exploits or endangers children. We remove it, close the accounts involved, keep the evidence, and report it to the authorities, in Switzerland to clickandstop.ch.
9.1 Reporting. You can report content, members, plans or events by writing to [email protected], or with the report function where the app offers one. This address is also our point of contact for questions about these terms and about content on the platform; we answer in English or German.
9.2 What we may do. If content or behaviour breaks these terms or the law, we may remove or hide the content, limit features for the account involved, or suspend or close it. We decide in proportion to the seriousness of the case. Organizations can also act within their own communities.
9.3 How we decide. We review reports with the help of automated tools and human review. Decisions that significantly affect you, such as suspending your account, are not taken by automated means alone.
9.4 Reasons and complaints. When we restrict your content or account, we tell you what we did and why, unless the law prohibits it. You can contest the decision within six months by writing to [email protected], or with the appeal function where the app offers one. A person who was not involved in the original decision reviews it, and we tell you the outcome. Your right to go to court is not affected.
10.1 What it is. Some Ocio websites and apps offer an AI assistant that answers questions, helps you find offers and prepares bookings for you. The final step, booking or confirming, is always taken by you (see § 10.3).
10.2 It can make mistakes. The assistant's answers are generated automatically and can be wrong or incomplete. Check important information, such as times, prices and conditions, on the organization's page before relying on it. The assistant does not give medical, legal, financial or other professional advice.
10.3 What counts. Only what you confirm yourself counts: a booking or purchase exists only once you have completed it and received a confirmation. Nothing the assistant says changes a price, a booking or an organization's terms.
10.4 Your conversations. Conversations with the assistant are processed by AI service providers on our behalf, as described in the Privacy Policy. Do not share health information or other sensitive personal data with it.
11.1 Your participation.
(a) Physical participation. Using products and services listed on the Ocio platform may require you to take part physically. Whether this participation is suitable for you is a matter between you and the organization. Ocio, including its AI assistant, only provides information about suitability. You release Ocio from any liability for harm caused to you by your participation or non-participation, including but not limited to financial loss, injury, and physical, psychological or personal harm.
(b) Other people and unfamiliar environments. Using products and services listed on the Ocio platform may involve interacting with other people in unfamiliar environments. Ocio does not control these factors, and their description is limited to information made available by third parties, which Ocio does not verify. You release Ocio from any liability for harm caused to you by such interactions or environments, including but not limited to financial loss, injury, and physical, psychological or personal harm.
(c) Places and times. Products and services may be provided at particular places and times, in public or private places. Ensuring access to these places, and their adequate comfort, safety and suitability, is not something Ocio does. You release Ocio from any liability for harm caused to you by the place or time at which a product or service is provided, including but not limited to financial loss, injury, and physical, psychological or personal harm.
(d) Qualifications of providers. You are responsible for satisfying yourself that the provider of a product or service is qualified. If a provider chooses to give us a certificate or qualification, we may publish it, but we do not verify or guarantee it. You release Ocio from any liability for harm caused to you by a provider's lack of qualification, including but not limited to financial loss, injury, and physical, psychological or personal harm.
12.1 Participation criteria. Organizations may set criteria for who can take part in or access their products and services. Ocio may publish and inform you about some of these criteria if the organization provides them, but cannot guarantee that they are complete or accurate. You release Ocio from any liability for harm caused to you by such criteria or by being refused, including but not limited to financial loss, injury, and physical, psychological or personal harm.
12.2 Refusal is the organization's decision. If an organization refuses you a product or service, this is the organization's own decision, even where the refusal is arbitrary or discriminatory. It cannot be attributed to Ocio, to Apsara Software GmbH or to any of its representatives.
12.3 Disputes. Any dispute between an organization and an end user must be taken up directly between them. Ocio is not a mediator; our role is limited to coordination and communication. Refunds of payments made through the Ocio platform under § 4.4 are processed through the Ocio platform. Ocio may also facilitate the payment of extraordinary refunds or compensation; doing so does not make Ocio a mediator, a participant in the dispute or a party to it.
13.1 How we protect your data. Passwords and other secrets, such as access keys, are stored only in encrypted form. Passwords are stored in a one-way encrypted form (hashed), so nobody, including us, can read them. We take reasonable technical and organizational measures to keep your data safe, to control who can access it, and to keep backups. If a security incident affects your data, we inform you as the law requires.
13.2 What we do not store. By design, we do not store sensitive payment information such as credit card numbers or payment credentials. These are handled directly by our payment provider.
13.3 Your password is yours alone. You must not share your password or give anyone other than yourself access to your account. Tell us at once at [email protected] if you think someone else has used your account.
13.4 Chat and messages. Messages are stored on our servers and are not end-to-end encrypted. Do not send passwords, payment details, identity documents or health information in chat or messages.
13.5 Release of liability. You release Ocio from any liability for loss or harm caused by:
(a) your own actions or omissions that compromise your account, such as sharing your password or not keeping it secure;
(b) coordinated or organized cyber attacks on the Ocio platform or its service providers;
(c) security gaps in our systems that had not been identified and were not left open with malicious intent.
13.6 Notifications. Notifications by email, text message or push notification are described in § 4.12 of the Privacy Policy. They are provisional and non-binding; what applies is the information in your account and the organization's confirmation and terms. You accept the risks of these channels described there, in particular lack of confidentiality, manipulation, delay or loss of a notification, and access by third parties, and you release Ocio from any liability for loss or harm resulting from them. Keep your email address and phone number up to date. Charges of your mobile network provider apply under your agreement with it.
14.1 No guarantee of availability. We work to keep the Ocio platform available, but we do not guarantee that it, or any feature, will be available at all times, without interruption or free of errors.
14.2 Maintenance. We may carry out maintenance, updates and repairs that interrupt or limit the platform. Where possible, we schedule planned maintenance at times of low use and announce longer maintenance windows in advance.
14.3 Disruptions outside our control. The platform can be disrupted by events outside our control, such as failures of networks, power or internet connections, outages at our hosting, payment or other service providers, and force majeure.
14.4 Changes to features. We may change, add or remove features of the platform at any time.
14.5 Release of liability. You release Ocio from any liability for loss or harm caused by the platform or a feature being unavailable, interrupted, slow or changed, including during maintenance or network disruptions, for example a booking that could not be made in time.
15.1 Limits of the releases. The releases of liability in these terms, in particular in § 5.3, § 11, § 12.1, § 13.5, § 13.6 and § 14.5, apply to the extent permitted by law. They do not limit our liability under § 15.2.
15.2 Our liability. We are liable without limitation for damage caused intentionally or through gross negligence, for injury to life, body or health, and wherever the law does not allow liability to be limited. For damage caused by slight negligence we are liable only to the extent mandatory law requires it.
15.3 What we are not responsible for. We are not responsible for what organizations offer and deliver, for content posted by organizations or other users, or for events listed by third parties (see § 4.6 and § 4.7), except where we are at fault ourselves.
15.4 Your statutory rights. Nothing in these terms limits rights that the consumer protection law of your country gives you and that cannot be waived.
How we handle your personal data is described in the Ocio Privacy Policy, and how we use cookies in the Ocio Cookie Policy. Organizations you deal with also handle your data for their own purposes and explain this in their own privacy notices.
17.1 By you. You can ask us to delete your account at any time by writing to [email protected], or delete it yourself in your account settings where the app offers this. Bookings you have already made and payments you owe an organization are not cancelled by deleting your account; contact the organization about them.
17.2 By us. We may suspend or close your account if you seriously or repeatedly break these terms or the law, if this is needed to protect other people or the platform, or if the law requires it. Where possible we warn you first and tell you the reasons (see § 9.4). We may also close accounts that have not been used for three years, after telling you by email at least 30 days in advance.
17.3 If we stop the service. If we discontinue the platform or an app, we will tell you in good time.
18.1 We may change these terms, for example when we add features or the law changes. We will tell you about important changes by email or in the app at least 30 days before they apply.
18.2 For important changes, we will ask you to accept the new version when you next sign in. If you do not accept it, you can close your account; the previous version continues to apply to what happened before the change.
19.1 These terms are governed by Swiss law, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer living in another country, you also keep the protection of the mandatory consumer law of that country.
19.2 Courts in Zürich, Switzerland, have jurisdiction. If you are a consumer, you can also bring a claim before the courts where you live, and we can only sue you there.
19.3 If any part of these terms is invalid, the rest remains in force.
19.4 We may transfer these terms to a company that takes over the Ocio platform; we will tell you beforehand. You may not transfer your rights under these terms.
19.5 These terms are available in English and German. If the two differ, the English version applies.
